Terms and Conditions


Netbridge™ reserves the right to deny access to any potential Client at its discretion.
Netbridge™ shall provide the Client with access to the World Wide Web network known as the Internet including communications and data exchange with other organizations that have access to the Internet.

This access will be available 24 hours per day, 7 days per week except during operational faults or scheduled maintenance and is hereafter referred to as "the Service".
Netbridge provides no guarantees regarding the availability of the Service. The Client indemnifies Netbridge™ against any losses by the Client resulting from non availability of the Service
Any advice provided by an Officer of Netbridge™ provided in good faith. Any Client who acts on advice of an Officer of Netbridge™ does so at the Client's own risk, and indemnifies Netbridge™ against any problems that may arise from acting upon that advice.

The Service cannot be used by an individual or group of persons for any activities of an illegal or fraudulent nature and/or unauthorized use of copyright material.
All Dial-up accounts are for single dial-up access only. This means that the Service cannot be accessed for more than one concurrent session.

Payment

The Client agrees to pay all such charges as are incurred through usage of the Service.
Payments are collected by means of a debit order system implemented by Netbridge™.
If the Netbridge™ is unable to collect payment via the debit order system due to insufficient funds within their bank account, Netbridge™ reserves the right to immediately and without notice withdraw access to the Service.

Netbridge™ reserves the right to vary the rate of charging at any time by giving the Client a minimum of 20 days notice before such charges comes into effect. This notice may be in the form of e-mail, post, or update on the Web.
It is the Client's responsibility to notify the Netbridge™ in writing if the Service is no longer required.

The Client agrees to pay all such charges as are incurred in the recovery of any monies owing to the company, not limited to bank fees, collection agency fees and stationary costs.


Client Responsibilities

The Client will not use the Service so as to interfere with of disrupt network users, services or equipment. Disruptions include, but are not limited to distribution of unsolicited advertising, propagation of computer worms and viruses, transmitting of excessive traffic (such as ping floods), using the network to make unauthorized entry to any other machine accessible via the Service, sending harassing or threatening electronic mail and forgery (or attempted forgery) of electronic mail messages and Usenet news postings.

The Client agrees to refrain from posting of messages to inappropriate Usenet newsgroups, to refrain from mass, unsolicited mailing's, to post advertisements only where appropriate, and in venues that specifically encourage or allow advertising.
The Client hereby indemnifies Netbridge™ in respect to any loss or damage action claim suit or proceeding against Netbridge by any person arising out of use of the Service by the Client including but not limited to the transmission of any illegal and/or fraudulent material.

It is the Client's responsibility to ascertain the full cost of accessing Netbridge™, including but not limited to carrier charges imposed by any telephone company used to access the Service. Although Officers of Netbridge™ may provide advice regarding telephone carrier charges, it is the Client's responsibility to confirm this advice by contacting their carrier directly.
The use of the Service is at the sole risk of the Client. Netbridge™ does not and cannot monitor or control the content and information accessed via the Service and Netbridge™, its agents or its employees shall not be held responsible in any way for any content or information accessed via the Service.

The Client is responsible for the selection and use of security features and back up any information. Netbridge™ takes no responsibility for any information or data stored on its machines or passing trough the network.
The Client takes full responsibility for all users of Netbridge™, whether such usage is a result of deliberate and/or negligent action on their part.

Netbridge™ has no control over the content of material available over the Internet. Parents are cautioned to supervise their children closely and all customers are cautioned to use due care when using any software acquired over the Internet

Termination

This Agreement may be terminated by either party with the giving of 30 days notice to the non-terminating party.

Netbridge™ reserves the right to temporarily disconnect the Client in the event of serious operational security incidents arising through the Client's connection to Netbridge™, or in the event of continued abuse of this agreement by the Client.
Either party is entitled to immediately terminate this agreement by notice in writing to the other party in the event that: the other party has committed a material breach of this agreement and failed to rectify this breach within 20 days of receiving notice of the breach; or if an order is made or an effective resolution is passed for the winding up of the other party; or an administrator of the other party is appointed.

 

DOMAIN NAMES AND DOMAIN NAMES DISPUTES:


Netbridge will not be held liable for any disputes arising out of domain name registrations or domain name hosting on behalf of the client.

Netbridge will not be held liable for any losses or damages the client may suffer due to a domain name being reallocated, transferred or deleted by any Domain Name Authority

Netbridge reserves the right to take ownership of any domain name upon cancellation by the client should the client not specify any action to be taken in regards to ownership or transfer of the domain name.

Netbridge requires 24 hours written notification via fax prior to releasing any domain name. Where the client has not notified Netbridge of his intention to transfer or move a domain name, all transfer requests will be declined.

Netbridge will retain the ownership of the domain name in the event of the client's accounts not being settled in full on termination of the hosting agreement.  

 

 

AUP


This is the Acceptable Usage Policy (AUP) applicable to customers of Netbridge™. Customers are reminded that, in accordance with our standard terms and conditions, all use of services provided by Netbridge™ must be in compliance with it. Failure to comply may result in the suspension and/or termination of services without warning.

The primary goals of this AUP are:

a) to protect the Internet infrastructure, and other Internet users
b) to protect Internet Assist's servers, network and customers, and our ability to provide services to our customers
c) to protect Internet Assist's reputation and ensure we are able to act as a responsible Internet service provider

It is based on some general standards of behaviour accepted by the general Internet community but is not an exhaustive document. We reserve the right at all times to act to protect our reputation, networks and servers.

The Internet and its infrastructure fundamentally rely on mutual co-operation and consideration between both users and service providers. Therefore we (and you) have a responsibility to maintain the highest standards in these respects for the benefit of all. Furthermore, if we permit any abuse of the Internet via or related to our services, our ability to provide services to you and other customers may be impaired.

Within This Policy.
"You", “Your” refers to any customer of Netbridge™. Remember that, according to our standard terms and conditions, you are responsible for the actions of anyone that you allow to access services provided to you by Netbridge™, so you must ensure that anyone else who uses the services is aware of and complies with this AUP.
"Services" means any Connectivity Services (as defined in our Standard Terms and Conditions) provided to you by Netbridge™.

1. You must not use any Services to facilitate, permit or assist in the sending of unsolicited bulk e-mail (often referred to as “spam”).
2. You must not use or authorise the use of unsolicited e-mail or newsgroup postings to advertise any Services. This applies even if you do not send the communications via the Services. For example, you must not send unsolicited bulk e-mail advertising a Web site that is hosted with Netbridge™.
3. Notwithstanding the above, you must not use the Services to transmit e-mail to a person or company via, or relating to, the Services after they have specifically requested that you do not contact them. It is your responsibility to ensure that any automated mail system you employ complies with this.
4. You must not use any Services for any illegal purpose(s) including, without limitation, for the purpose of obtaining unauthorised access to any computer or service.
5. You must not use any Services to facilitate, allow or assist in any “Denial of Service” (DoS) attack.
6. You must not use any Services in such a way which would detrimentally affect our servers (including, without limitation, consuming excessive resources) or our ability to provide services to other customers.
7. You must not use any Services to collect replies to communications sent from any source, where those communications violate this AUP or the usage policy of the source provider.
8. You must not use any Services to provide access to or distribute any illegal material or material which would violate the rights of any third party (including but not limited to copyright).
9. 

You must not exceed any agreed limits or restrictions of any kind on the use of any Services (including, without limitation, disk usage, bandwidth usage or data transfer quotas).

10. Username/Password combinations supplied by Netbridge are not transferable. It is the sole responsibilty of the end-user to to keep usernames and passwords confidential. Simultaneous logins violating this agreement constitutes an illegal action.
